Trustee Update on the Court proceedings
I advised in November that it was possible that the Court would decide that the C Plan claim should be adjourned to February 2013 so that it could be heard at the same time as the Good Faith claim. The Trustee applied to the Court for an Order that the C Plan claim should proceed to a trial in May 2012. This application was opposed by IBM. At a hearing on 2 December 2011, the Judge accepted the submissions made on behalf of the Trustee and the trial date for the C Plan claim is now fixed for May 2012. The Judge was of the view that IBM had the resources to be ready for a trial in May 2012 and rejected submissions to the effect that the C Plan trial should not take place until February 2013.
