5 April 2009 deadline for pension benefit protection – clarification

 

A letter has been issued to members at their home address recently reminding them that they have until 5 April 2009 to apply for Primary Protection of pension benefits with HM Revenue & Customs. This is in connection with legislation that became effective on 6 April 2006 (A-Day). This letter has been issued as recommended by the Pensions Regulator.

 

The Trustee does not know your personal circumstances, particularly any other pension entitlements that you may have and consequently, the letter has been issued to all categories of members. The vast majority of members, (current employees, retirees and deferred) will be unaffected by this and will not need to register. 

 

If you are a retiree of IBM and are already in receipt of your IBM pension and it amounts to less than approximately £66,000 per year, then providing you have no other pension benefits elsewhere, you do not need to take any action on the letter.

 

If your are a retiree of IBM and your IBM Pension exceeds approximately £66,000 per year, then you do not need to consider taking any action if you retired before 6 April 2006, unless you have further pension benefits that accrued before 5 April 2006 that are still to come into payment (excluding any State Pension), and/or you have accrued, or anticipate accruing, further pension benefits since 6 April 2006.

 

If you are a current employee of IBM then you need only consider taking action if your total pension benefits exceeded £1.5 million as at 5 April 2006. The vast majority of IBM employees will not need to consider applying for protection as their value will not be at this level.
